Legal counsel is initial information provided upon analysis of the basic information and documents provided by the Client to the Law Firm. Providing such advice does not include preparing any draft documents. Legal counsel includes an assessment of the Client’s legal situation, recommendations as to further actions, information on costs related to running the case, and an offer including remuneration for running the case.

Bei der Rechtsberatung handelt es sich um eine Erstinformation, die auf der Grundlage einer Analyse der grundlegenden Informationen und Unterlagen erteilt wird, die der Mandant der Kanzlei zur Verfügung stellt. Im Rahmen der Beratung werden keine Dokumententwürfe erstellt. Die Rechtsberatung umfasst eine Beurteilung der Rechtslage des Mandanten, Empfehlungen für das weitere Vorgehen, Informationen über die mit der Führung des Falles verbundenen Kosten und ein Angebot für die Vergütung der Führung des Falles.

The cost of legal counsel is PLN 492 (gross amount). Running the case is priced separately as part of legal advice and depends on the Law Firm’s Client’s needs. An offer for remuneration for running the case is presented by e-mail after analysis of the materials and information provided by the Client.

Der Preis für die Rechtsberatung beträgt 492,- PLN brutto. Die Führung eines Falles wird separat, als Teil der Rechtsberatung, berechnet und hängt von den Bedürfnissen des Mandanten der Kanzlei ab. Das Vergütungsangebot für die Führung des Falles wird per E-Mail vorgelegt, nach der Analyse der vom Mandanten bereitgestellten Unterlagen und Informationen.

Koszt porady prawnej to 492,- zł brutto. Prowadzenie sprawy wyceniane jest odrębnie, w ramach porady prawnej i uzależnione jest od tego, czego dotyczą potrzeby Klienta Kancelarii. Oferta na wynagrodzenie za prowadzenie sprawy przedstawiana jest mailowo po analizie materiałów i informacji udzielonych przez Klienta.

Yes. In this case, the Client is required to send information and documents related to the case. If necessary, we also carry out complementary consultations with the Client.

Ja. Zu diesem Zweck ist es erforderlich, dass der Mandant uns Informationen und Unterlagen zu seinem Fall übermittelt. Falls erforderlich, führen wir auch ergänzende Konsultationen mit dem Mandanten durch.

Tak. W tym celu niezbędne jest przesłanie przez Klienta informacji i dokumentów związanych ze sprawą. W razie potrzeby przeprowadzamy także uzupełniające konsultacje z Klientem.

Appointments are made directly with the lawyer who is to handle the case and in accordance with the appointment calendar maintained by the Law Firm’s Office Manager. The appointment is confirmed by text message or e-mail. Depending on the Client’s needs and possibilities, meetings are held in our office or remotely (online).

Die Terminvereinbarung erfolgt direkt mit dem Anwalt, der den Fall bearbeiten soll, und in Übereinstimmung mit dem Terminkalender, der von der Büroleiterin der Kanzlei geführt wird. Der Termin wird per Textnachricht oder E-Mail bestätigt. Je nach den Bedürfnissen und Möglichkeiten des Mandanten finden die Besprechungen in der Kanzlei oder aus der Ferne (online) statt.

Spotkania umawiane są bezpośrednio z prawnikiem, który ma zajmować się sprawą i zgodnie z kalendarz spotkań prowadzonym przez Office Manager Kancelarii. Termin spotkania jest potwierdzany w formie SMS lub e-mail. W zależności od potrzeb i możliwości Klienta spotkania odbywają się w Kancelarii lub formie zdalnej (on-line).

All documents related to the case as well as a description and calendar of the case should be prepared for the meeting. After reviewing the above-mentioned materials, the lawyer handling the case will inform the Client about which of the materials will be useful for the case. We strongly recommend that you submit these materials by e-mail prior to your appointment.

Für die Besprechung sollten alle mit dem Fall zusammenhängenden Unterlagen sowie eine Beschreibung und ein Zeitplan des Falles vorbereitet werden. Nach Durchsicht der oben genannten Unterlagen wird der Anwalt, der den Fall bearbeitet, den Mandanten darüber informieren, welche der vorbereiteten Unterlagen für den Fall nützlich sein werden. Wir empfehlen dringend, die oben genannten Unterlagen vor dem Termin per E-Mail zu übermitteln.

Na spotkanie należy przygotować wszystkie dokumenty związane ze sprawą, jak również opis i kalendarium sprawy. Po zapoznaniu się z ww. materiałami adwokat zajmujący się sprawą poinformuje Klienta o tym, które z przygotowanych materiałów będą przydatne dla sprawy. Zdecydowanie rekomendujemy przekazanie ww. materiałów drogą mailową przed umówionym spotkaniem.

All materials provided by Clients are covered by legal professional privilege. The security of any information and materials provided by Clients is guaranteed by the internal procedures and work organisation of the Law Firm.

Alle von den Mandanten zur Verfügung gestellten Unterlagen fallen unter das Anwaltsgeheimnis. Die Sicherheit der von den Mandanten bereitgestellten Informationen und Materialien wird durch die internen Verfahren und die Organisation der Arbeit der Kanzlei gewährleistet.

Wszystkie przekazywane przez Klientów materiały są objęte tajemnicą adwokacką. Bezpieczeństwo informacji i materiałów przekazywanych przez Klientów zagwarantowane jest poprzez wewnętrzne procedury i organizację pracy Kancelarii.

The rules for the recovery of costs depend on the stage of the case. At the pre-litigation stage, the recovery of costs is hampered by the lack of legal regulations providing adequate cost protection. Therefore, although we always take action on behalf of the Client to recover the costs incurred by the Client, it is up to the Client to decide whether the amount agreed with the opposing party is acceptable to the Client and allows the case to be concluded.

At the court stage, the law provides opportunities to recover larger sums - both court fees and attorney’s fees - while the Court’s decision on costs depends on the outcome of the case in each instance. The general rule is that the losing party is obliged to reimburse the successful party for the costs of the litigation.

Die Regeln für die Kostenerstattung hängen vom Stadium des Falles ab. In der vorprozessualen Phase ist die Kostenerstattung schwierig, da gesetzliche Regelungen fehlen, die einen angemessenen Kostenschutz gewährleisten. Daher werden wir zwar immer im Namen des Mandanten tätig, um die ihm entstandenen Kosten einzutreiben, doch obliegt es dem Mandanten, zu entscheiden, ob der mit der gegnerischen Partei vereinbarte Betrag für ihn akzeptabel ist und den Fall zum Abschluss bringt.

In der gerichtlichen Phase sieht das Gesetz die Möglichkeit vor, höhere Beträge - sowohl Gerichts- als auch Anwaltskosten - einzufordern, während die Kostenentscheidung des Gerichts vom Ausgang des Verfahrens abhängt. Generell gilt, dass die unterlegene Partei verpflichtet ist, der obsiegenden Partei die Prozesskosten zu erstatten.

Zasady odzyskiwania kosztów uzależnione są od etapu sprawy. Na etapie przedsądowym odzyskiwanie kosztów jest utrudnione z uwagi na brak regulacji prawnych zapewniających właściwą ochronę kosztów. W związku z tym, pomimo tego, że każdorazowo podejmujemy w imieniu Klienta działania zmierzające do odzyskania poniesionych przez Klienta kosztów, to od Klienta zależy, czy uzgodniona ze stroną przeciwną kwota jest dla Klienta akceptowalna i pozwala zakończyć sprawę.

Na etapie sądowym przepisy prawa dają możliwości odzyskania większych kwot – zarówno opłat sądowych, jak i wynagrodzenie za prowadzenie sprawy - natomiast rozstrzygnięcie Sądu co do kosztów jest każdorazowo uzależnione od wyniku sprawy. Ogólna zasada stanowi, że strona przegrywająca proces zobowiązana jest do zwrotu kosztów procesu na rzecz strony wygrywającej.
